Washington real estate brokers are governed by the Real Estate Brokerage Relationships Act (RCW 18.86) and related regulations (WAC 308-124 series). All real estate activity by Vancouver Property Group is conducted in compliance with these statutes.

The Law of Real Estate Agency — Required Disclosure

Under RCW 18.86.030, Washington State law requires that real estate brokers provide clients and potential clients with the pamphlet titled "The Law of Real Estate Agency" before a buyer or seller signs a representation agreement or an offer to purchase or sell real estate, whichever comes first.

This pamphlet describes the legal duties owed by a real estate broker to all parties in a transaction, and the specific additional duties owed to the broker's own client. Key points covered in the pamphlet include:

  • The duty of reasonable care and skill in performing brokerage services
  • The duty of honest and good faith dealings with all parties
  • The duty to present all written offers and agreements promptly
  • The duty to disclose all material facts known to the broker that affect the buyer's willingness to purchase or the seller's willingness to sell
  • The additional duties owed exclusively to the broker's own client, including loyalty, confidentiality, and reasonable advice

Agency Relationships in Washington State

Washington State law (RCW 18.86) recognizes several types of agency relationships in real estate transactions. Understanding your relationship with a broker is important before entering any agreement. The following are the primary agency relationship types you may encounter:

Seller's Agent (Listing Agent)

A seller's agent represents the seller in a real estate transaction. The seller's agent owes the seller duties of loyalty, confidentiality, disclosure, obedience, reasonable care and skill, and accounting. The seller's agent must put the seller's interests first.

Even when working with a buyer who is interested in a listed property, a seller's agent's primary obligation is to the seller — not to the buyer. Buyers dealing with a seller's agent are owed basic duties of honesty and disclosure of material defects, but not the full fiduciary duties owed to the seller.

Buyer's Agent

A buyer's agent represents the buyer in a real estate transaction. The buyer's agent owes the buyer duties of loyalty, confidentiality, disclosure, obedience, reasonable care and skill, and accounting. The buyer's agent must put the buyer's interests first.

A buyer's agent works to find suitable properties, advise on offer strategy, negotiate terms in the buyer's favor, and guide the buyer through the transaction process. A formal buyer representation agreement is required under Washington law to establish this relationship.

Dual Agency — Disclosed Limited Agent

A dual agency situation arises when the same brokerage represents both the buyer and the seller in the same transaction. Under RCW 18.86.060, a broker may act as a dual agent — also called a "disclosed limited agent" — only with the written, informed consent of both the buyer and the seller.

In a dual agency arrangement:

  • The broker owes duties to both parties but cannot fully advocate for either party's interests against the other
  • The broker must keep confidential each party's motivations, bottom line, and negotiating strategy unless that party consents to disclosure
  • The broker continues to disclose all material facts to both parties
  • The dual agency must be disclosed in writing, and both parties must consent in writing before the relationship begins

Vancouver Property Group will always disclose the nature of any dual agency situation and obtain the required written consents before proceeding. You are never required to consent to dual agency.

Non-Agent / Transaction Coordinator

In limited circumstances, a broker may facilitate a transaction as a non-agent, providing ministerial services without representing either party. This type of relationship, if applicable, will be disclosed to all parties in writing.
